2. Acceptance of the Terms
By accessing the website, creating an account, using the services, or placing an order, the user declares that they have read, understood, and unequivocally accepted these Terms and Conditions, which constitute a distance contract in accordance with Government Emergency Ordinance No. 34/2014, Law No. 365/2002, and Article 1270 of the Romanian Civil Code.
3. Content and Intellectual Property
The content of this website (including texts, images, logos, and design) is protected under Romanian Copyright Law No. 8/1996 and the applicable intellectual property legislation.
The reproduction, distribution, or modification of any content without the prior written consent of Xenon Bright is strictly prohibited.
Terms, software components, or graphic elements may not be used without prior authorization.
4. Website Use
By using this website, you agree to:
• Use the website solely for informational purposes or for making legitimate purchases;

• Refrain from placing fraudulent orders;

5. Products and Information Presented
Product descriptions and images are provided for informational purposes only. Minor differences in color, appearance, or specifications may occur.
Product availability is updated in real time. If a product is no longer available, you will be notified within a maximum of 24 hours.
6. Prices and Validity
All prices displayed are in Romanian Lei (RON) and include the applicable Value Added Tax (VAT) (19%).
We reserve the right to modify prices or promotional offers at any time without prior notice, in accordance with Article 1270 of the Romanian Civil Code and Article 14 of Government Emergency Ordinance No. 34/2014.
7. Payment Methods
We accept the following payment methods:
• Online payment by Visa, Mastercard, or Maestro through MobilPay, Revolut, or Klarna (including "Pay in 3" and "Pay in 4" options) – no additional fees apply.
• Cash on Delivery (COD) – no additional fees apply.
• Bank transfer – based on the proforma invoice, payable to our UniCredit Bank account (see Section 1).
• Installment payments through Klarna or TBI Pay, subject to the offers available on the website – no additional fees are charged by us.
8. Delivery and Shipping
International Courier (Romania & EU)
• Romania: 1–3 business days; EU: 3–7 business days (depending on the destination).
• Orders placed before 3:00 PM are processed on the same business day.
• Easybox (Romania) – via Sameday, available 24/7.
• Parcel inspection upon delivery – optional and subject to an additional fee; this service can be selected during the ordering process.
• Shipping costs are displayed transparently before the order is completed.
• In the event of an unjustified refusal to accept a parcel, the shipping costs shall be borne by the customer.
9. Right of Withdrawal
In accordance with Articles 9–12 of Government Emergency Ordinance No. 34/2014 and Directive 2011/83/EU, consumers (individuals) have the right to withdraw from a distance purchase within 14 calendar days without incurring any penalties.
The withdrawal period begins on the date the product is received.
Products must be returned in their original condition, and the return shipping costs shall be borne by the customer, except in the case of defective or incorrectly delivered products.
If the mandatory legal information has not been properly provided, the customer is entitled to an extension of the withdrawal period by an additional 12 months.
10.Pricing Errors, Stock Availability and Order Cancellation
Xenon Bright makes every reasonable effort to ensure that product information, prices, promotions and stock availability displayed on the website are accurate and up to date. However, technical, human, synchronization or data processing errors may occasionally occur.
Placing an order constitutes a purchase request submitted by the customer. The distance contract is considered concluded when Xenon Bright confirms, on a durable medium, its acceptance of the order, in accordance with applicable law.
Xenon Bright reserves the right to refuse or cancel an order before confirming its acceptance where justified circumstances exist, including but not limited to:
- an obviously incorrect price displayed due to a technical, human, import, synchronization or data processing error;
- incorrect application or unintended combination of discounts, promotions, vouchers or commercial rules;
- a discrepancy between the stock displayed on the website and the actual physical stock available;
- product unavailability resulting from an inventory, synchronization or stock update error;
- errors concerning product specifications, variants, quantities, product codes or other information essential to fulfilling the order;
- malfunctions affecting the website, database, IT systems or integrations with suppliers or other platforms;
- reasonable indications that an order is fraudulent, abusive or has been placed by knowingly exploiting an obvious technical error.
If such a situation is identified, the customer will be informed within a reasonable period. The order may be cancelled in full or, with the customer's agreement, modified in respect of the products that can be supplied under the correct conditions.
If payment has already been collected for an order that is subsequently cancelled, Xenon Bright will refund in full the amount paid for the products or services that cannot be supplied, generally using the same payment method used by the customer and without additional charges.
An automated notification confirming that an order has been received or registered does not, by itself, constitute confirmation that the order has been accepted by Xenon Bright, provided that this is clearly stated in the communication sent to the customer.
In the event of an obvious pricing error, Xenon Bright shall not be required to supply the product at the incorrectly displayed price where, considering the circumstances, the error is manifest and could reasonably have been recognised as such, subject to applicable consumer protection legislation.
11. Warranty
We provide a legal warranty in accordance with Romanian Law No. 449/2003, with a minimum warranty period of 2 years for consumers and 1 year for legal entities. Full details are available in our Warranty Policy.
12. Data Protection
We process personal data in accordance with the General Data Protection Regulation (GDPR) and the applicable Romanian legislation. Details regarding data processing, your rights, and the applicable procedures are available in our Privacy Policy.
13. System Security
The website operates over a secure SSL/TLS encrypted connection across the entire domain.
We implement appropriate security measures, including encryption, backups, firewalls, and restricted access, to protect our systems and customer data.
14. Limitation of Liability
Xenon Bright shall not be liable for:
• Website unavailability or technical errors;
• Delays caused by courier services or customs authorities;
• Issues resulting from the improper use of products;
• Indirect damages, loss of profits, or personal IT-related issues.
15. Force Majeure
In accordance with Articles 1351–1356 of the Romanian Civil Code, both parties shall be exempt from liability for the non-performance of their obligations where such non-performance is caused by force majeure events beyond their reasonable control. The affected party shall notify the other party within five (5) days, and both parties shall take reasonable measures to minimize the effects of such events.
16. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of Romania. Any disputes shall first be resolved amicably. If no amicable settlement can be reached, the competent courts of Tulcea, Romania, shall have jurisdiction, in accordance with Article 126 of the Romanian Code of Civil Procedure.
17. Amendments to the Terms
We reserve the right to update these Terms and Conditions, policies, prices, or products at any time. The version published on the website at the time an order is placed shall apply. Continued use of the website constitutes tacit acceptance of any such updates.
18. Final Provisions
These Terms and Conditions constitute the entire agreement between the parties. Any amendments or updates shall form an integral part of these Terms and Conditions and shall become effective immediately upon publication.
